1. Acceptance of Terms
By accessing or using the Platform, you confirm that you are at least 13 years of age and that you accept and agree to these Terms. If you do not agree, do not use the Platform.
2. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@vibeplat.ai if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Your Content
You retain ownership of the code and materials you upload to the Platform ("Your Content").
By uploading content, you grant VibePlat a non-exclusive, worldwide, royalty-free license to store, host, archive, parse, display, and make copies of Your Content solely as necessary to operate and provide the Platform.
If you post content you did not create, you are responsible for ensuring you have the right to post it and for complying with any applicable licenses. If Your Content already includes a license granting us the permissions we need, no additional license is required.
4. Public Apps and Remixing
When you set your application to public, you agree that all other users of the Platform may view and remix your code. You are responsible for ensuring your content is appropriate for public sharing before changing its visibility settings.
By making your app public, you grant other users a license to view and build upon your code, subject to any open-source license you have applied to it. VibePlat is not responsible for how other users use or remix your publicly shared content.
A remix may be generated by an artificial-intelligence service acting on our behalf, which receives the public app's listing and code in order to build it. The services we use and what each receives are listed in our Privacy Policy.
5. Licensing Compliance
You represent and warrant that Your Content complies with all applicable open-source licenses (including but not limited to MIT, Apache 2.0, and GPL) and any other third-party intellectual property rights. VibePlat does not review or verify the licensing status of uploaded code. You are solely responsible for any licensing violations arising from your uploads.
6. Prohibited Conduct
You agree not to:
- Upload content you do not have the right to share
- Use the Platform for any unlawful purpose
- Attempt to gain unauthorized access to other users' accounts or content
- Upload malicious code, viruses, or any software intended to harm others
- Scrape, crawl, or otherwise extract data from the Platform in an automated manner without our permission
- Harass, abuse, or harm other users
- Upload, publish, or link to pornography or sexually explicit content, including explicit or gratuitous depictions of nudity or sexual activity
- Upload or publish content that sexualizes a minor, or that is otherwise designed to exploit or endanger children
- Upload or publish gratuitous gore, or prolonged, graphic, or sadistic depictions of realistic violence
- Upload or publish gambling or simulated gambling, including casino-style games such as slot machines, poker, blackjack, and roulette, whether played for real money, virtual currency, or points
7. Intellectual Property
VibePlat and its logos, design, and software (excluding user-uploaded content) are the property of VibePlat and are protected by applicable intellectual property laws. You may not copy, modify, or distribute our proprietary materials without our prior written consent.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. VIBEPLAT DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEPLAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR YOUR CONTENT.
10. Indemnification
You agree to indemnify and hold harmless VibePlat, its affiliates, officers, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Platform, Your Content, or your violation of these Terms.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Apps You Publish and User Data
If an app you publish sends information about the people who use it to a server outside VibePlat, whether you or a third party operates it, you are responsible for that collection, and you agree to:
- Tell users what you collect and why before you collect it
- Collect only what your app needs to work
- Not ask for passwords or other credentials for VibePlat or for any service other than your app, government identification numbers, payment card or bank account details, or precise location
- Not knowingly collect personal information from children under 13
- Keep what you collect reasonably secure, and delete a user's information when they ask you to
- Not use information collected through your app to identify users across other apps or to contact them outside your app without their permission
Data your app saves through the VibePlat SDK is stored by VibePlat and governed by our Privacy Policy, not by this section.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last updated" date above. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
14. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. You may terminate your account at any time through your account settings. Upon termination, your right to use the Platform ceases, but Sections 3, 5, 9, 10, 11, and 12 survive termination.
15. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
